Terms & Conditions

1. Acceptance of Terms

By enrolling as a member, creating an account, or utilizing services through Flight Circle, you agree to be bound by these Terms & Conditions, the Club Bylaws, Operating Rules, and any additional policies issued by The Aviator Collective (“the Club”).

These Terms constitute a binding agreement between you (“Member”) and the Club.

2. Membership Eligibility & Status

  • Membership is subject to approval by the Club.

  • The Club reserves the right to approve, deny, suspend, or terminate membership at its sole discretion.

  • Membership is non-transferable.

  • Members must remain in good standing, including financial, operational, and behavioral compliance.

3. Billing Authorization

By maintaining an account with the Club, you authorize the Club to:

  • Charge your payment method on file for all applicable fees

  • Store payment information securely via third-party processors

  • Process recurring and non-recurring charges

Failure to maintain valid payment information may result in suspension of privileges.

4. Fees & Charges

Members agree to the following categories of charges:

4.1 Membership Fees

  • Monthly dues are billed automatically

  • Dues are non-refundable unless otherwise stated

4.2 Flight Charges

  • Aircraft usage is billed based on Hobbs time as defined by Club policy

  • Rates are subject to change with notice

4.3 Additional Charges

May include, but are not limited to:

  • Fuel discrepancies

  • Cleaning fees

  • Late return fees

  • Damage or misuse charges

  • Instructor or checkout fees

5. Payment Terms

  • All charges are due upon invoice or automatically processed

  • Outstanding balances may result in immediate suspension of booking privileges

  • Accounts past due may incur late fees at the maximum allowable rate

The Club reserves the right to pursue collection for unpaid balances.

6. Scheduling & Cancellations

  • All reservations must be made through Flight Circle

  • Members must adhere to scheduling policies outlined in the Operating Rules

  • Late cancellations or no-shows may incur fees

  • The Club reserves the right to modify or cancel reservations for operational necessity

7. Aircraft Use & Responsibility

Members agree to:

  • Operate aircraft in accordance with FAA regulations and Club policies

  • Maintain proper certifications, currency, and qualifications

  • Conduct proper preflight and post-flight procedures

  • Report discrepancies (squawks) promptly

Members are financially responsible for damage resulting from:

  • Negligence

  • Violation of policies

  • Improper operation

8. Fuel & Expense Reimbursement

  • Fuel purchases away from base must follow Club procedures

  • Reimbursement is subject to submission of valid receipts

  • Unauthorized purchases may not be reimbursed

9. Maintenance & Downtime

  • Aircraft availability is not guaranteed

  • The Club is not liable for losses due to maintenance delays, weather, or operational constraints

  • Scheduled maintenance takes priority over reservations

10. Insurance & Liability

  • The Club maintains aircraft insurance in accordance with industry standards

  • Members may be responsible for deductibles or uncovered losses depending on circumstances

  • Members operate aircraft at their own risk within the scope of Club insurance

Members are strongly encouraged to obtain renter’s insurance.

11. Member Conduct

Members agree to uphold a high standard of professionalism and safety, including:

  • Respect for aircraft, members, instructors, and staff

  • Adherence to all Club policies and procedures

  • No misuse, reckless behavior, or unsafe practices

Violation may result in suspension or termination.

12. Suspension & Termination

The Club may suspend or terminate membership for:

  • Non-payment

  • Safety concerns

  • Policy violations

  • Conduct detrimental to the Club

Termination does not relieve the Member of outstanding financial obligations.

13. Refund Policy

Unless otherwise stated:

  • Membership fees, dues, and initiation fees are non-refundable

  • Account credits may be issued at the Club’s discretion

14. Dispute Resolution

Any disputes arising under these Terms shall:

  • First be addressed through good-faith discussion

  • If unresolved, be subject to mediation or arbitration as determined by the Club

Venue and governing law shall be in the State of Texas.

15. Policy Updates

The Club reserves the right to update these Terms & Conditions at any time. Continued use of Club services constitutes acceptance of revised Terms.

16. Acknowledgment

By maintaining an active account and participating in Club activities, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
